Akshara - Library & Study Hall Management Terms & Conditions

The terms that govern your use of Akshara - Library & Study Hall Management.

These Terms and Conditions ("Terms") govern your use of Akshara, a subscription software service developed and operated by Pingal IT Solutions ("Pingal IT", "we", "our" or "us"). They apply to the Akshara web application, the public library pages served from it, and the Akshara mobile applications we intend to release in a future phase.

By creating an account, subscribing, or using Akshara in any way, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

1. About Akshara

Akshara helps owners of libraries, study halls and reading rooms manage students, seats and shifts, monthly fees and dues, expenses, admissions and reporting. It is a tool for running your business. It does not provide accounting, tax, legal or financial advice, and figures it produces should be checked before being relied on for statutory filings.

2. Eligibility and your account

  • You must be at least 18 years old and legally capable of entering a contract.
  • Akshara is intended for business use by library owners and the staff they authorise.
  • You must provide accurate account and billing information and keep it current.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • Tell us promptly at info@pingalit.com if you believe your account has been accessed without authorisation.

3. Subscriptions, billing and renewal

  • Akshara is sold as a recurring subscription. The plan you choose sets the limits that apply to your account, including the number of libraries, active students and staff members.
  • A reduced introductory price may be offered for an initial period. After that period the subscription renews at the standard recurring price for the plan.
  • Prices are shown before you confirm a purchase and are exclusive of taxes unless stated otherwise. Applicable taxes, including GST, are added and shown on your invoice.
  • Where you authorise automatic payments, your subscription renews automatically at the end of each billing cycle using the mandate you approved, until you cancel.
  • Payments are processed by our payment gateway partner. We do not store your card, UPI or bank credentials.
  • Upgrading a plan takes effect immediately, with the remaining value of the current cycle adjusted against the new plan. A downgrade takes effect at the end of the current billing cycle.
  • If a renewal payment fails, we may retry it and notify you. If payment remains outstanding, access to the Service may be limited or suspended until the amount is paid.

4. Cancellation and refunds

  • You may cancel at any time from within the application. Cancellation stops future renewals.
  • On cancellation you keep access until the end of the billing cycle you have already paid for.
  • Except where required by law, subscription fees already paid are not refundable for a partial period, and we do not refund on the basis of unused capacity within a plan.
  • If you believe you have been charged in error, contact us within 30 days of the charge and we will investigate.

5. Your data and your responsibilities

You keep ownership of the data you enter into Akshara. You grant us the licence necessary to host, process, transmit, back up and display that data in order to provide the Service, and to share it as described in the Privacy Policy.

Because much of that data concerns other people — your students and prospects — you are responsible for:

  • Having the right to collect and enter each person's information;
  • Telling those people how their information will be used, including that it may be shared with our service providers and business partners as set out in the Privacy Policy;
  • Obtaining any consent the law requires, including verifiable consent from a parent or guardian where a student is a minor;
  • Keeping records accurate, and responding to your students when they ask to see, correct or delete their information;
  • Complying with applicable data-protection, consumer and record-keeping law.

You must not upload information you are not entitled to hold, or documents whose storage would breach the law.

6. Acceptable use

You must not:

  • Use Akshara for any unlawful, fraudulent or deceptive purpose;
  • Upload malware, or attempt to breach, probe or disrupt the Service or the accounts of others;
  • Attempt to access data belonging to another account;
  • Copy, modify, decompile, reverse engineer, or create derivative works from the Service, except to the extent the law expressly permits;
  • Resell, sublicense, rent or share your access with anyone outside your own business, or circumvent plan limits;
  • Scrape or extract data by automated means other than the export features we provide;
  • Use the Service to send unsolicited or unlawful messages;
  • Misrepresent your identity or your authority to act for a business.

7. Staff, co-owners and permissions

You may invite co-owners and staff and assign them roles. You are responsible for who you invite, for the permissions you grant, and for removing access when someone leaves. Anything done through an invited account is treated as done by you. Staff numbers count against the limits of your plan.

8. Public library pages and QR codes

Akshara can publish a page for your library, reachable by a QR code or link, showing details such as your facilities, shift timings, fees and seat availability, according to the visibility settings you choose. You are responsible for the accuracy of what you publish there and for where you display the code. We may throttle or disable a public page that is being abused.

9. Communications

By holding an account you agree to receive service communications — verification and password messages, payment and renewal notices, security alerts, and important changes to the Service. These are part of the Service and cannot be switched off while your account is active. Optional notifications can be managed in your settings.

10. Availability, support and changes

  • We work to keep Akshara available, but we do not guarantee uninterrupted or error-free operation.
  • Planned maintenance may make the Service briefly unavailable. We try to schedule it outside busy hours.
  • We may add, change or withdraw features as the product develops. Where a change materially reduces a core feature of your plan, we will give reasonable notice.
  • Support is provided by email at info@pingalit.com during business hours.

11. Mobile applications (planned release)

We intend to release Akshara mobile applications in a future phase. When they are available:

  • These Terms and the Privacy Policy apply to them as they do to the web application.
  • Your use is also subject to the rules of the app store you download from, and the licence granted for the app is personal, limited, non-exclusive and non-transferable.
  • We may release updates, and some updates may be required in order to keep using the app.
  • The app requests device permissions — such as camera, files or notifications — only for the related feature, and you may refuse or withdraw them in your device settings, accepting that the related feature will then not work.
  • The app requires an internet connection; your carrier's data charges are your responsibility.

12. Intellectual property

Akshara, including its software, design, interface, documentation, name and branding, is owned by Pingal IT Solutions and protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, and nothing more. Feedback or suggestions you send us may be used freely to improve the product without obligation to you.

13. Third-party services

The Service depends on third parties, including our payment gateway and our message-delivery and hosting providers. We are not responsible for their acts or omissions, and their services are governed by their own terms.

14. Suspension and termination

  • You may stop using Akshara and cancel your subscription at any time.
  • We may suspend or terminate an account for non-payment, breach of these Terms, unlawful use, or where required by law. Where circumstances allow, we will give notice and a chance to put the matter right.
  • Following termination, you will have a reasonable period to export your data before it is deleted in line with the retention rules in the Privacy Policy.

15. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, as to merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. You are responsible for verifying figures produced by the Service before relying on them for financial, tax or legal purposes.

16. Limitation of liability

To the fullest extent permitted by law, Pingal IT Solutions is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, arising from your use of or inability to use the Service. Our total aggregate liability arising out of or relating to the Service is limited to the subscription fees you actually paid to us for the Service in the three months immediately preceding the event giving rise to the claim.

17. Indemnity

You agree to indemnify and hold Pingal IT Solutions harmless from claims, damages, liabilities and reasonable legal costs arising out of the data you enter into the Service, your breach of these Terms, or your failure to meet your obligations to the people whose information you record.

18. Changes to these Terms and to pricing

We may revise these Terms from time to time. The revised version will be posted on this page with a new "Last Updated" date, and takes effect on publication. We may also change subscription prices; a price change will not affect a billing cycle already paid for, and we will give reasonable notice before it applies to your renewal. Continuing to use the Service after a change takes effect means you accept it.

19. Governing law and jurisdiction

These Terms are governed by and interpreted in accordance with the laws of India. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the competent courts in Jaipur, Rajasthan, India.
